Terms of Service

These Terms of Service govern your use of Deliberate Play (the “Service”), the UX interview training platform at https://app.deliberate-play.com, operated by ProductMicrobe BV, Adolf Baeyensstraat 109, 9040 Sint-Amandsberg, Belgium (VAT BE0729995472).

By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

ProductMicrobe BV reserves the right to review and amend these Terms at any time and at our sole discretion. Upon doing so, we will update this page. Any changes take effect immediately upon publication. Your continued use of the Service constitutes acceptance of the updated Terms.

2. Limitations of Use

By using Deliberate Play you warrant that you will not:

  • modify, copy, reproduce, transmit, or create derivative works of any part of the Service;
  • use the Service for any unlawful purpose or in a way that breaches applicable law or regulation;
  • attempt to gain unauthorised access to any part of the Service, its related systems, or the networks connected to it;
  • transmit any unsolicited or unauthorised advertising or promotional material (spam);
  • harvest, collect, or use personal data about other users without their explicit consent;
  • use any automated tool (scraper, bot, crawler) against the Service without prior written consent.

3. Intellectual Property

The Service and all content, software, features, and functionality on it are owned by or licensed to ProductMicrobe BV and are protected by Belgian and international intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, or create derivative works without our express written permission. This licence terminates automatically if you breach any of these Terms.

4. Payments and Merchant of Record

Credit packs are sold and fulfilled by Paddle.com Market Ltd (“Paddle”), acting as our Merchant of Record. Paddle is the seller of record for all purchases and is responsible for collecting and remitting applicable taxes. By completing a purchase you also agree to Paddle’s Terms of Service. Our Refund Policy applies to all purchases made through Paddle.

5. Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. ProductMicrobe BV does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of Liability

To the fullest extent permitted by applicable law, ProductMicrobe BV, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • loss of profits or revenue;
  • loss of data;
  • loss of business or goodwill;
  • interruption of business;

arising from your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot be excluded under mandatory Belgian consumer law.

7. Accuracy of Materials

The content in the Service is provided for general information purposes only. ProductMicrobe BV does not warrant the accuracy, completeness, or currency of any content. You rely on such content at your own risk.

8. Links to Third-Party Sites

The Service may contain links to external websites not operated by ProductMicrobe BV. We have no control over the content or practices of those sites and accept no liability for them.

9. Termination

ProductMicrobe BV reserves the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or the Service.

10. Severance

If any provision of these Terms is found to be invalid or unenforceable by a competent court, it will be modified to the minimum extent necessary to make it enforceable. All other provisions remain in full force and effect.

11. Governing Law

These Terms are governed by the laws of Belgium (Vlaanderen). Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Ghent (Gent), unless mandatory consumer law in your country of residence provides otherwise.
